Will of William Blackburn (1718-1774)

I William Blackburn of Whitby in the County of York Master Mariner being of sound mind memory and understanding (praise be God) do make this my last Will and Testament in manner and form following (that is to say) I give and bequeath unto my daughter Mary now the wife of Mr William Watson the four hundred pounds which the said William Watson now stands indebted to me on Bond with all the Interest that shall be due thereon at the time of my decease which Bond I do hereby order shall be delivered up to the said William Watson

Also I give to my said Daughter Mary Watson the sum of five hundred pounds to be paid in Twelve Months next after my decease

Also I give unto for my said Daughter Mary all the Household furniture which I bought for her

Also I give to my son Israel Blackburn my two new Erected dwellinghouses with the appurtenances situate on Wapping Wall in the parish of Shadwell London late in the possession of John Miller his assigns or under tenants To hold unto my said son Israel Blackburn his Executors Administrators and Assigns according to such Estate as I have therein or thereto

Also I give and devise unto my two sons Jacob Blackburn and John Blackburn and to their Heirs and Assigns for ever All that new built House wherein I now dwell situate in Whitby aforesaid in a Street called Church Street with the yards Garden and Appurtenances belonging to the same and all the House Houses or Tenements situate in the said Yard now in the several occupations of Alice Anderson William Brown and Matthew Butterfield and also all those four houses or Tenements with them Appurtenances now in the several occupations of Thomas Hutchinson Alice Molson Robert Dawson and Strong Hodgson situate in a yard adjoining to the North end of this said Newbuilt House to be equally divided between my said two sons Jacob and John share and share alike subject and liable nevertheless to and with the payment of one annuity of fifteen pounds a year unto my wife Elizabeth Blackburn for and during the term of her natural life which I give unto her in lieu and full satisfaction of her Dower or Thirds and all other claims and demands forth or out of my Real and personal Estates But in case I shall happen to die before the youngest of my said two sons Jacob and John shall have attained the Age of Twenty One years then and in such case and not otherwise I do hereby give all my said Houses and Tenements in Whitby aforesaid unto my Brother John Blackburn and my Friends Thomas Thompson and Mark Noble and the Survivor of them and the Heirs of such Survivor To hold the same from the Time of my decease In Trust and for the use and benefit of my said two sons Jacob and John until the youngest of them shall attain the Age of Twenty one years

Also I do hereby give unto my Daughter Jane Blackburn five hundred pounds to be paid her twelve months next after my decease

Also I give unto my son William Blackburn five hundred pounds to be paid in twelve months next after my decease and I do hereby give unto my said two Sons Jacob and John after payment of the said Legacies Annuity my just debts and funeral expenses all my Ship or Vessell called Ocean and all my parts of Ships and all my Household Furniture whatsoever with all the Rest Residue and Remainder of my Real and Personal Estate to be equally divided between them share and share alike But if it shall happen at the time of my decease that the youngest of my two sons Jacob and John shall not attain the age of Twenty One years Then and not otherwise I do hereby give unto my said brother John Blackburn and my friends Thomas Thompson and Mark Noble or the survivor of them and the Executors and Administrators of such survivor all my said Ship called the Ocean and all my parts of Ships and Household Furniture whatsoever and all the Rest Residue and remainder of my Real and Personal Estate whatsoever In Trust and for the use and benefit of my said two sons Jacob and John until the youngest of them shall attain the age of twenty one years And I do request that the said John Blackburn Thomas Thompson and Mark Noble will take upon them the Tuition of such of my said Sons and shall at my decease be under the age of Twenty One years and I do also desire that the Rents of my said Houses in Whitby after the said Annuity the Land Tax and other Assessments are deducted and the profits of my said Ship and the produce of my personal estate may be divided into two equal parts and paid yearly unto the elder of them after he attains the Age of Twenty one years until the younger attains that Age and I do hereby authorise and impower my said Brother John Blackburn Thomas Thompson and Mark Noble and the survivor of them and the Heirs Executors and Admins. Of such survivor to sell or mortgage any part of my said Houses or the said Ship for payment of the said Legacies And it is my will if they or any of them shall be put to any costs or charges relating to the Trusts aforesaid that they shall be repaid or allowed the same on demand and shall not be accountable for bad debts and it is also my will if my said daughter Jane Blackburn shall happen to die before the end of twelve calendar months next after my decease and without issue that her Legacy shall be equally divided amongst my said children or their representatives

Also it is my will and I do hereby order and direct that if either of my said sons Jacob and John shall happen to die before they attain the age of Twenty One years and without lawful issue that the part or share of the estate and effects as above mentioned given to him so dieing shall go to the survivor of them his Heirs Executors Administrators and Assigns and it is also my will if my said son William Blackburn shall die without issue before his Legacy shall become due that the same shall be divided amongst my children and their representatives and I do hereby make nominate and appoint my said brother John Blackburn Thomas Thompson and Mark Noble Executors of this my last Will and Testament In Witness whereof I have hereunto set my hand and seal the Twenty sixth day of April one Thousand Seven Hundred and Twenty Three WILLIAM BLACKBURN signed sealed and published by the said William Blackburn as and for his last Will and Testament in the presence of us who have subscribed our names as witness as thereto in the presence of the said Testator and of each other.
