PROBATE This is the last Will and Testament of me Isaac Cragg Smith of Merton Abbey in the County of Surry and of Bunhill Row in the parish of St Lukes in the County of Middlesex Esq. I desire to be buried in the same vault with my late Uncles Charles Smith Esq and Rear Admiral Isaac Smith and I desire the remains of my late dear wife may be resurrected from the vault in Bunhill Fields Burying Ground and deposited with mine in the same vault in the burial ground of Merton aforesaid and as to such real and personal Estate and Efforts wherewith it hath pleased God to bless and I dispose thereof in manner following In the first place I direct that my debts be paid as soon as conveniently may be after my decease by and out of my personal Estate and Effects which I hereby charge therewith and subject thereto and to the several legacies and annuities after mentioned I give devise and bequeath unto William Maddox Wyatt of Northumberland St in the city of Westminster Esq and John Day Blake of Palsgrave Place Temple London Gentlemen my much valued friends all and singular my Freehold and Copyhold Estates hereditaments and Premises and all my personal estate and effects whatsoever and wheresoever upon Trust as soon as may be after my decease to cause Inventories and Schedules to be made of all the Goods and Chattels household furniture and articles of household plate linen and china and about my respective houses at Merton Abbey and Bunhill Row aforesaid and it is my will that my dear father John Cragg shall have the free use and enjoyment of my dwelling house and premises in Bunhill Row aforesaid for his life and I give the same to him accordingly also I give and bequeath unto my same dear Father all the household Furniture and Articles of household plate Linen Books and China Goods and Chattels provisions wines and liquers in and about my same house in Bunhill Row accepting my debts and start in Trade for his use and benefit absolutely and to see disposed of as he may think fit and upon this further trust that my said Trustees to pay unto my said father one annuity or yearly sum of three hundred pounds by quarterly payments for and during his natural life the first payment to begin and be made on such of the said quarter days as next happen after my decease and I direct that my said dear father shall not be charged or liable to make good any dilapidations that may arise or happen by any means to my said house and premises in Bunhill Row And upon further trust to pay unto my dear cousin Mrs Elizabeth Cook widow of Clapham Surry one annuity or clear annual Sum of five hundred pounds for her life the same to be payable by quarterly payments the first payment to be made on such quarter day as shall next happen after my decease and also to permit and suffer my said dear cousin the use occupation and enjoyment of my dwelling house gardens and fields within the walls of Merton Abbey aforesaid as the same are now in my occupation together with all my goods and chattels household furniture and articles of household plate linen books and china to be specified in such schedule as aforesaid for and during her life also I give unto my said dear cousin all my stores of provision wines spirits and beer in and about my said dwellinghouse at Merton Abbey and upon further trust to pay my dear sister Elizabeth Cragg one annuity or yearly sum of twenty five pounds for her life payable quarterly aforesaid and I do direct that the same not be payable by anticipation nor liable to the debts or any contract of any person with whom she may marry I give and bequeath unto my dear sisters Mary Adams Ann Mackrell Maria Bennet Jane Marshall and Ursula Jew the sum of five hundred pounds each. Also I give unto my Brothers in Law James Adams Robert Mackrell John Leach Bennett John William Henry Marshall and James Jew the sum of one hundred pounds each Also I give unto my dear Father in Law Edward Wyatt of Merton aforesaid Esquire one hundred pounds for a Ring and as a mark of my esteem and regard also I give unto my sisters in Law Anne Jane Holroyd Wyatt and Fanny Wyatt nineteen guineas each for a ring also I give unto my brothers in Law Edward Wyatt Henry Wyatt and William Rice Holroyd nineteen guineas each for a ring Also I give unto my valued and esteemed friends George Hart John de Floury Joseph Covey John Grant and Joseph Fleming Esq nineteen guineas each for a ring And whereas by virtue of my marriage with my late dear wife deceased I am entitled in reversion on the decease of my said father in Law to shares of certain Estates late of my said Wifes Mother also deceased I do hereby give and bequeath the same unto my Niece and Goddaughter Caroline Holroyd her heirs executors administrators and assigns for ever In the event of Caroline Holroyds decease before she attains the age of 21 years the said reversionary Estates or property to pass to Louisa Wyatt the daughter of Henry and Ann Wyatt of Merton I give unto each of my servants who shall be living with me at the time of my decease whether in Merton or Bunhill Row the sum of fifteen pounds Also I give unto each of such servants and aforesaid an additional sum of five pounds for every year such servant may have been in my service and whereas it is my intention to give to my nephew James Adams the sum of five hundred pounds to apprentice him to some profession or trade now I do hereby order and direct my said Trustees and authorise and empower them to advance and expend such sum of five hundred pounds for the purposes aforesaid provided that I shall not have done so previously to my decease And whereas my late deceased Uncle Rear Admiral Isaac Smith by his will dated on or about the twenty eighth day of November in the year of our Lord one thousand eight hundred and twenty seven after devising unto me six several Estates therein mentioned as referred to declared that in case I should depart this life without having any issue of my body to inherit decline me that he earnestly wishes that I would bequeath all the freehold and copyhold Estates thereby bequeathed to me unto the eldest son of my Sister Ann Mackrell living at my decease on condition of his taking the surname of Smith only now I do hereby being a widower and without issue by my late dear wife in compliance with the expressee wish of my said dear Uncle give and bequeath unto Charles Mackrell the eldest son of the said Ann Mackrell his heirs executors and administrators all the said six several estates so devised and bequeathed to me as aforesaid he taking the surname of Smith and in case the said Charles Mackrell shall depart this life before he shall attain such age of twenty one in years then and in such case I give devise and bequeath all the aid six several Estates unto my Nephew Frederick Bennett his heirs and assigns but in such Estates are not to vest in him until he shall have attained his age of 21 years and he having also taken the surname of Smith only and in case the said FREDERICK BENNETT shall depart this life before he shall attain his age of twenty one years then and in that case I give devise and bequeath all the said six several Estates unto the eldest son of my sister JANE MARSHALL who shall be living at my decease but such Estates are not to vest in him until he shall attain 21 years and taken the surname of Smith, and only and in default of such issue to my own right heirs for ever And I do hereby in pursuance of the said Will of my said dear Uncle Rear Admiral Isaac Smith appoint my Brother in Law JOHN BENNETT Trustee of Bank Annuities bequeathed by him to the Minister and Church sons of the parish of Merton Also I give and bequeath unto my Brother in Law JAMES ADAMS the vault which I purchased in Bunhill Fields Burial Ground in like manner as the same is held by me all the rest residue and remainder of my Goods Chattels Estate and Effects whatsoever and wheresoever from and after payment of my debts funeral expenses annuities and legacies hereinbefore hereinafter or by and Codicil to be by me given I give and bequeath unto such person or persons as by the limitations aforesaid shall become entitled to the said six Estates before mentioned and referred to and lastly I do hereby appoint the said WILLIAM MADDOX WYATT and JOHN DAY BLAKE Executors of this my Will and I do give and bequeath unto each of them the sum of five hundred pounds for the trouble they will have in the execution of the Trusts of this my Will. In witness thereof I have to this my will contained in three sheets of paper set my hand to the five first sides thereof and my hand and seal to this the sixth and last side thereof this sixteenth day of September in the year of our Lord one thousand eight hundred and thirty one. THIS CODICIL made 25th day of October in the year of our lord 1831, I give and unto my old and faithful man employed by me in Bunhill Row, London JOSEPH STOARD the annual sum of twenty pounds clear from all charges of Legacy Duty or other charges for the term of his natural life. Also I give unto my old and faithful housekeeper JANE HODGES now living with me at Merton Abbey Surrey the annual sum of one hundred pounds free from all charges of Legacy Duty for the term of her life also I give unto CHARLES DODSWELL (the servant of my dear cousin Elizabeth Cook) the clear annual sum of £20 for his faithful services to her and my late lamented Uncle Rear Admiral Isaac Smith and the attention he paid to me during my late illness the said annuity to expire with his natural life the above three amounts to be charged upon the residue of my personal Estate which I desire my aforementioned Executors or their Executors or administrators will see punctually paid to these three old and faithful servants of myself and family and it is my will that my said two Executors or their executors or administrators shall deduct or detain to themselves or theirselves from the rents of the Estates devised by this my will or from any accumulations of money arising therefrom or from any accumulation of money from my personal Estate all costs charges or damages and expenses whatsoever that they or them shall or may at any time actually bear pay or sustain for or by or on account of the Trusts hereby reposed in them in defence as Executors or in administrators of this my said will and it is also my will that if either of the Legatees named in the body of this my said will or in this codicil shall in any way dispute or endeavour to alter my wishes at this disposal of my Estates and personal property so far as I have the full disposal of them that every such Legatee or Legatees shall for ever forfeit and lose all admin or title to any Estates or Money Legacys devised to them in this my said will and codicil Is CRAGG SMITH.
In the Goods of Isaac Cragg Smith Esq decd 28th Decr. 1831.
ON which day appeared personally William Ansell Boyle of Clements Inn in the County of Middlesex gentleman and Henry Balls of Roupoll Street, Blackfriars Road in the County of Surrey gentleman and made oath that they knew and were well acquainted with Isaac Cragg Smith late of Merton Abbey in the County of Surrey and of Bunhill Row in the Parish of Saint Luke in the County of Middlesex Esquire deceased for some time before and to the time of his death and wre also well acquainted with his manner and character of handwriting and subscription having frequently seen him write and also write and subscribe his name to writings and having more carefully and attentively viewed and inspected certain papers writings hereunto annexed purporting to be and contain the last will and Testament with a Codicil thereto of the same deceased the said Will beginning thus “In the name of God Amen This is the last Will and Testament of me Isaac Cragg Smith” ending thus “and my hand and seal to this the sixth and last six thereof this sixteenth day of September in the year of our Lord one thousand eight hundred and thirty one” and thus subscribed “I Cragg Smith” and having the following interlineations therein viz the words “my much valued friends” written in pencil between the twenty third and twenty fourth lines of the first side thereof. The words “In the event of Caroline Holroyds decease before she attains the age of 21 years and said reversionary Estates or property to pass to Louisa Wyatt the daughter of Henry and Ann Wyatt of Merton” written also in pencil at the top of the fourth side thereof and the words “widower and without Issue by my late dear wife” written in ink between the third and fourth lines of such fourth side counting from the bottom of the same The said codicil beginning thus “This Codicil made the twenty fifth day of October in the year of our Lord one thousand eight hundred and thirty one” ending thus “shall for ever forfeit and lose all them or title to any Estates or money legacies devised to them in this my said will and codicil” and thus subscribed “ I Cragg Smith” and having the following Interlineations therein “viz” the words or name “Jane Hodges” between the twelfth and thirteenth lines from the commencement thereof the words “or detain” between the eighth and with lines of the following and last side of same and the words “or in this codicil” between the twenty second and twenty third lines of the same side They respectively depose and say that they be verily and in their consciences believe the several interlineations in the said will so hereinbefore writes and set forth as also the whole body series and content of the said codicil together with the subscriptions thereto and the several interlineations therein to hereinbefore in like manner set forth to be of the proper handwriting and subscription of him the said Isaac Cragg Smith Esquire deceased W.A. PROVED at London with a Codicil 7th January 1832 before the worshipful John Danbury Doctor of Laws and Surrogate by the Oaths of William Maddox Wyatt and John Day Blake Esquires the Executors to whom and admon was granted having been first sworn duly to administer.
