1944 THIS IS THE LAST WILL AND TESTAMENT of me John William Henry Marshall of Ovingdean in the County of Sussex Clerk I give and bequeath to my wife Jane Marshall all my household goods furniture books plate linen china glass and liquors horses and carriages for her absolute use and benefit and bequeath by virtue and in service of every power enabling me in that behalf appoint all and singular my freehold and leasehold messuages and tenements lands advowson right of patronage and presentation of and to the Rectory and parish church of Ovingdean aforesaid heredits and premises whatsoever and wheresoever situate with their rights members and appurts unto and to the use of John Leach Bennett of Merton in the County of Surrey Esquire and Edward Cornford of Brighton in the said County of Sussex gentleman and their heirs executors arbiters and assigns according to the nature and quality of the same premises respectively Upon trust nevertheless and to and for the intents and purposes hereinafter expressed and declared of and concerning the same that is to say Upon trust that they the said John Leach Bennett and Edward Cornford and the survivor of them and the heirs executors arbiters and assigns of such survivor do and shall as soon as conveniently may be after my decease sell and dispose of my said freehold and leasehold messuages or tenements lands advowson right of patronage and presentation of and to the rectory and parish church of Ovingdean aforesaid heredits and premises so devised and bequeathed to them as aforesaid either altogether or in parcels and either by public auction or private contract to any person or persons who shall be willing to become the purchaser or purchasers thereof respectively for the most money and best price that can be reasonably had or gotten for the same And do hereby authorise and empower the said John Leach Bennett and Edward Cornford and the survivor of them and their heirs and assigns of such survivor at the same time and in the same manner as is hereinbefore expressed with respect to my freehold and leasehold heredits to sell and dispose of all and singular my copyhold or customary messuages tenements lands and heredits whatsoever and wheresoever situate with their rights members and appurtenances of And do hereby declare my will and mind to be that if my said messuages or tenements lands advowson right of patronage and presentation heredits and premises or any of them shall be put up to be sold by public auction it shall be lawful for the said John Leach Bennett and Edward Cornford or the survivor of them and their executors and assignes of such survivor to buy in the estate and premises which shall be offered for sale and to resell the same in manner hereinbefore mentioned without incurring any liability for the diminution of price or other loss if any which shall be occasioned thereby And I hereby declare my will and mind to be that until the freehold leasehold and copyhold heredits and premises hereinbefore given and bequeathed in trust to sell and authorised to be sold as aforesaid shall be actually sold it shall be lawful for the said John Leach Bennett and Edward Cornford and the survivor of them and the heirs executors admons and assignes of such survivor to use or occupy or to demise or lease the same freehold leasehold and copyhold heredits and premises for such number of years upon such terms and in such manner as they or he shall think fit and I do hereby declare my will and mind to be that the said John Leach Bennett and Edward Cornford and the survivor of them and the heirs executors admons and assigns of such survivor shall stand and be possessed of all and singular the monies to arise and be produced from the sale of my said freehold leasehold and copyhold heredits and premises advowson right of patronage and presentations aforesaid upon and for such trusts intents and purposes and with under and subject to such powers provisions and declarations as are hereinafter expressed of and concerning the residue of my personal estate and effects hereinafter given and bequeathed I do hereby give and bequeath All the rest Residue and Remainder of my personal estate whatsoever and wheresoever situated with the rights members and appurtenances thereunto respectively belonging unto the said John Leach Bennett and Edward Cornford their executors admons and assigns upon trust that they the said John Leach Bennett and Edward Cornford and the survivor of them and the executors admons and assigns of such survivor do and shall sell and dispose of and convert into money all same such part of my personal estate as shall not consist of money And out of the money arising from such sale of my real estate and such conversion of my personal estate and such part of my personal estate as shall consist of money do and shall pay all my just debts funeral and testamentary expenses and after payment thereof do and shall with all convenient speed after my decease by and out of the said trust monies invest the sum of two thousand pounds sterling in the purchase of a competent share of the parliamentary stocks or public funds of Great Britain or at interest upon government or real securities in their or his names or name with power to alter and vary the same and pay the interest dividends and annual produce of the same to my said wife Jane Marshall for her life if she shall so long continue my widow and unmarried but not otherwise And in case my said wife shall marry again then I order and direct and I do hereby declare my will and mind to be that from and immediately thereafter the trustees or trustee for the time being of this my will do and shall by and out of the said trust monies invest the sum of one thousand pounds sterling only in the purchase of a competent share of the parliamentary stock or public funds of Great Britain or an interest upon government or real securities in their or his names or name with power to alter and vary the same and pay the interest dividends and annual produce of the said sum of one thousand pounds only to my said wife for her life for her separate use and benefit independently of any husband and so as to be free from his debts control and engagements and the receipt or receipts in writing of my said wife notwithstanding and to be sufficient discharges for the same And as to the residue and surplus of the said trust monies from and immediately after my decease And as to the said sum of two thousand pounds and the stocks funds and securities whereon the same shall have been invested and the interest dividends and annual produce thereof from and after the decrease or a marriage again of my said wife which shall first happen also as to the said sum of one thousand pounds and the stocks funds and securities whereon the same shall have been invested and the interest dividends and annual produce thereon from and after the decease of my said wife do and shall stand possessed of and interested in the same respectively in the trust for such of my children as shall be living at my decease and as being a son or sons shall attain the age of twenty one years or being a daughter or daughters shall attain the age or marry with the consent of her or their guardian or guardians respectively and also for such of the issue of any child or children of mine then dead leaving issue then living as being a male or males shall attain the age of twenty one years or being a female or females shall attain that age or marry with the consent of her or their guardian or guardians respectively such child or children and issue objects of this trust if more than one to take as tenants in common but so that the issue of a deceased child or deceased children shall be entitled through all the trustees only to the share or respective shares which his her of their parent or respective parents would have been entitled to if living and the share of each such child children or issue respectively of the said residue or surplus trust monies to be paid as the respective periods aforesaid as soon as conveniently may be after my decease and the share of each such child children or issue respectively of and in the said two thousand pounds to be paid at the respective periods aforesaid or as soon after as the decease or marriage again of my said wife will permit and the share of each such child children or issue respectively of and in the said sum of one thousand pounds to be paid all the respective periods aforesaid or as soon after as the decease of my said wife will permit provided as soon and as and I declare my will to be and I hereby authorise and empower the said trustees or other trustee or trustees for the time being of this my will from time to time during the minority or respective minorities of any such children or issue as aforesaid by and out of the respective trust monies to which he she or they respectively shall or may be actually or presumptively or otherwise entitled to pay and apply for the maintenance education and advancement in the world such sum or sums of money as the said trustees or trustee for the time being shall think fit And I do hereby declare that the provision herein before made for my said wife Jane Marshall is so made for her as aforesaid in lieu bar and satisfaction of the dower or thirds and freebench to which by the Common Law or by custom or otherwise she my said wife may or otherwise might have become entitled of or in any lands or heredits of which it may die possesses for any estate of inheritance or for any state to which dower or freebench is incident And I do hereby declare that the receipt or receipts of the trustees for the time being of this my will for any sum or sums of money payable to them under or by virtue of this my will or in or about the exercise of any of the trusts or powers hereinbefore declared or contained shall be a sufficient and effectual discharge or sufficient and effectual discharges for the same or so much thereof respectively as in such respective receipts shall be expressed or acknowledged to be received And that the person or persons to whom the same shall be given his her or their executors admons and assigns shall not afterwards be answerable or accountable for any loss misapplication or nonapplication or be in anywise obliged or concerned to see to the application of the money therein mentioned to be received provided always and I hereby declare my will and mind to be that if the said trustees hereby appointed or either of them or any trustee or trustees to be appointed as hereinafter mentioned shall die in my lifetime or shall at my decease renounce the trusts thereof or be incapable of acting therein or in case any such trustee shall at anytime after my decease die or decline or become incapable to act in the aforesaid trusts hereby reposed in them or him respectively before the same shall be fully performed and satisfied then and so often as it shall so happen it shall and may be lawful to and for the surviving or continuing trustees or trustee for the time being by any deed or deeds instrument or instruments in writing to be sealed and delivered by them him or her to appoint one or more person or persons to be trustee or trustees in the room of the trustee or trustees so dying or refusing or becoming incapable to act as aforesaid and that upon every such appointment the said trust estates monies stocks funds and securities and premises shall be converted assigned and transferred to and in such manner that the same may become vested in the new trustee or new trustees jointly with the continuing trustee or trustees or incase there shall be no continuing trustee or trustees then in such newly appointed trustee or trustees only upon the trusts and for the intents and purposes herein before declared remaining the same and every such new trustee or trustees shall have such and the same powers and authorities and discretion to all intents and purposes whatsoever as if he or they had been originally nominated a trustee or trustees in this my will provided also and hereby declare my will and mind to be that the said several trustees hereby nominated and appointed or to be appointed by virtue of the proviso lastly hereinbefore contained and each and every of them shall be charged and chargeable respectively only for such monies as they shall respectively actually receive by virtue of the trusts hereby in them reposed notwithstanding his or their or any of their giving or signing or joining in giving or signing any receipt or receipts for the sake of conformity And anyone or more of them shall not be answerable or accountable for the other or others of them or for the acts receipts neglects or defaults of the other, or others of them but each and every of them only for his and their servants receipts or neglects or defaults respectively and that any one or more of them shall not be answerable or accountable for any banker broker or other person with whom or in whose hands any part of the said trust monies shall or may be deposited or lodged for safe custody or otherwise in the execution of the trusts hereinbefore mentioned and that they or any of them shall not be answerable or accountable for the insufficiency or deficiency of any security or securities stocks or funds in or upon which the said trust monies or any part thereof shall be placed out invested or any other misfortune loss or damage that may happen in the execution of the aforesaid trusts or in relation thereto except the same shall happen through their own wilful default respectively And also that it shall be lawful to and for and I hereby direct them the said trustees hereinbefore named and such future trustee or trustees to be appointed as aforesaid and every or any of them their and every of their heirs executors admons and assigns by and out of the monies which shall come to their respective hands by virtue of the trusts aforesaid to retain to and reimburse himself and themselves respectively and also to allow his and their cotrustee and cotrustees all costs charges damages and opened which they or any of them shall or may suffer sustain expend disburse be at or be put unto in or about the execution of the aforesaid trusts or in relation thereto And especially I hereby declare that any present or future trustee or this my will who is or shall be of the profession of an attorney or solicitor shall be entitled to make the same charges for business professionally transacted for the trust estate as such trustee would have been entitled to make for such business if he had not been a trustee any rule of law or equity to the contrary not withstanding And I do hereby constitute and appoint my said wife Jane Marshall so long as she shall continue my widow And after her decease or marriage again which shall first happen the said John Leach Bennett and Edward Cornford and their survivor of them guardian and guardians of the person and persons and fortunes of my children during their respective minorities I give and bequeath to my servant Richard Avis the sum of five pounds if he shall be in my service at the time of my decease And I appoint the said John Leach Bennett and Edward Cornford Executors of this my will Hereby revoking all former wills and codicils by me at any time heretofore made In witness whereof I the said John William Henry Marshall the testator have to this my last will and testament contained in this the eight preceeding sheets of paper set my hand and seal to wit my hand to and on the bottom of each of the said eight sheets my hand and seal to this last sheet and my seal at the top of the said sheets where all the said sheets are fixed together this thirteenth day of February one thousand eight hundred and thirty six J.W.H. Marshall The writing contained in this and the eight preceding sheets of paper was signed sealed by the above named John William Henry Marshall and by him published and declared as and for his last will and testament in the presence of us who in his presence at his request of each other have hereunto subscribed our names as witnesses. Appeared Personally Mary Atkinson of the city of Carlisle spinster and James John Adams of No 27 New Broad Street in the City of London Surgeon and jointly and severally made oath that they knew and was well acquainted with the Reverend John William Henry Marshall late of Ovingdean in the County of Sussex Clerk deceased for several years before and down to the time of his death and that having during such their acquaintance with the deceased frequently seen him write and subscribe his name to writings they have thereby respectively become well acquainted with the manner and character of his handwriting and subscription of the deponents having more respectively carefully observed and perused the paper writing hereunto annexed which purports to be and contain a Codicil to the last will and testament of the said deceased which said codicil begins thus “I hereby bequeath nineteen guineas each to my two executors named in my will” ends thus “in token of my esteem and regard” and is thus dated Ovingdean Decr 30th 1837 and is thus subscribed J W H Marshall they further jointly and severally made oath that they verily and their consciences believe the whole body series and contents of the said Codicil beginning and ending as before recited and also the said recited date appearing to the same and the said recited signature or subscription J W H Marshall also appearing set and subscribed there to as aforesaid to be all of the own proper handwriting and subscription of the said deceased MARY ATKINSON on the 19th day of April 1841 the said Mary Atkinson was only sworn as usual to the truth of the aforegoing affidavit before me F.
