Changed his surname to Smith from Mackrell on 18th December 1843, which was required by the Will of his Uncle Isaac Cragg Smith, in order that he could inherit.

The Queen has been pleased to grant unto Charles Robert Mackrell of Collingbourne Ducas, near Pewsey in the county of Wiltshire, Esq., her royal licence and authority that he may, in compliance with a clause contained in the last will and testament, and also of testifying his grateful and affectionate regard to the memory of his maternal uncle, Isaac Cragg Smith, late of Merton Abbey, in the county of Surrey, Esq., henceforth take and assume the surname of Smith only, instead of his present surname of Mackrell; and also to commend that the said royal concession and declaraion be registered in Her Majesty's college of Arms, otherwise the said royal licence and permission to be void and on non effect.

) IN THE NAME OF GOD AMEN. This is the last Will and Testament of Robert Mackrell of Collingbourn Ducis in the County of Wilts but at this time residing at Merton Abbey in the County of Surrey. I desire as to what property it has pleased God to bless me with to dispose of as follows. To my dear wife whom I appoint sole Executrix in trust the interest of two thousand three hundred and twenty eight pounds in the 3 p cent reduced annuities standing in the name of Ann Mackrell wife of Robert Mackrell. (bequeathed to us by her dear Uncle Rear Admiral Isaac Smith for her natural life and then be divided equally between my two dear children John and Louisa Mackrell or any children I may have younger by my present Wife. I also bequeath unto my dear wife the interest of my other property, whether in the funds or elsewhere and with all my stock in trade and book debts at Collingbourn Ducis aforesaid or any other place at the time of my decease after paying my just debts and funeral expenses until my said two dear children John and Louisa Mackrell or others younger by my present wife attain the age of twenty one and at that time to be equally divided between them I also bequeath unto my dear son Charles Robert Mackrell the sum of fifteen pounds for a ring as a token of my regard to him (he being provided for by his dear Uncle I.C. APPEARED PERSONALLY Ann Mackrell of Collingbourn Ducis, widow, William Mackrell of Collingbourn Kingston in the same County and, Joseph Mackrell of the same place, gentlemen and made oath as follows and first the said Ann Mackrell widow for herself made oath that she is the relict and sole executrix named in the last will and testament hereunto annexed of Robert Mackrell late of Collingbourn Ducis aforesaid deceased who departed this life on the fourth day of October one thousand eight hundred and thirty nine the said will beginning thus In the Name of God Amen This is the last will and testament of me Robert Mackrell of Collingbourn Ducis in the County of Wilts but at this time residing at Merton Abbey in the County of Surry ending this one thousand eight hundred and thirty two admitting of the interlineation of the word younger on the first page and thus subscribed “Robert Mackrell” and that on the day of the said deceased death this appeared on searching amongst the said deceased papers of moment and concern found in a box where the said deceased was in the habit of keeping his papers of consequence the paper writing hereunto annexed which was sealed but not in any envelope whereupon this appeared opened and read over and inspected same which she found to be the will of the said deceased bearing date the twenty fourth day of July one thousand eight hundred and thirty two and the name of John Cragg an intimate friend of the deceased subscribed as witness thereto with the date August 1st 1832 written underneath the same as now appears and she further made oath that the said John Cragg is since dead to wit on the sixteenth day of September now last past and the appearer further made oath that she hath made careful and diligent search amongst the said deceased papers of moment and concern but hath not found any will or testamentary paper writing whatsoever and except the paper writing now hereunto annexed nor hath any other come this appeared hands possession or knowledge and she lastly made oath that the said will is now in every respect in the same plight and condition as when found and read over and inspected by her as aforesaid And the said William Mackrell and Joseph Mackrell for themselves made oath that they knew and were well acquainted with the said Robert Mackrell deceased for sometime before and down to the time of his death and as so with his manner and character of handwriting and subscription having frequently seen him write and also write and subscribe his name and having carefully viewed and inspected the paper writing hereunto annexed purporting to be and contain the last will and testament of the said deceased beginning and ending and subscribed as aforesaid the appearers severally make oath and say that they verily in their consciences believe the whole body series and contents of the said will and the subscription thereto be all the proper handwriting and subscription of the said deceased. 18.12.1909 Shoreditch Observer. DEATH OF A CITY SOLICITOR. Mr John Mackrell, who has died at his residence High Trees, Clapham Common at the age of 85, was admitted a solicitor in 1845. He was Master of the Cordwainers Company in 1907, and at one time solicitor to the Irish Society, and to the Governments of New Zealand and New South Wales. Mr Mackrell endowed, through the Law Society, a prize known as the “John Mackrell Prize” for articled clerks who on passing their final examination, “should have shown the greatest practical knowledge of, and capacity to, advise upon and transact matters of business falling within the province of a practising solicitor, as distinct from the mere knowledge of the principles and practice of the law.”

A portrait of him appears in the picture now at the Guildhall representing the presentation of an address to Mr Chamberlain at the Cordwainers Hall.

MR J MACKRELL. " The death is announced of Mr John Mackrell of High Trees, Clapham common aged 85, who was one of the oldest solicitors on the roll.

Mr Mackrell was admitted in 1845, and in 1849 joined the later Mr Millard, then Clerk to the Cordwainers' Company, in partnership. He afterwards came on the Court of that Company, and was Mastger in 1897-8. In 1862-3 he served the office of senior Under Sherriff of London and Middlesex, and was then appoined solicitor to the Honourable the Irish Company, who were at that time involved in serious litigation in respect of the reclamation of Lough Foyle. Mr Mackrell, however, was successful in bringing about a settlement. Soon afterwards he became solicitor in England to the Governments of New Zealand and New South Wales, and he drew the attention of Sir Julius Vogel, Premier of New Zealand, who was then in England, to the benefit which would result if the Colonial Government loans were raised by the issue of inscribed stock. Sir Julius Vogel, with the assistance of Mr Mackrell and in consultation with the Colonial Secretary, negotiated with the Bank of England for the issue and inscription of Colonial stock. The co-operation of the other Colonial Governments was obtained, and after the terms of the Bill had been settled it was introduced in the House of Commons. Mr Parnell first blocked it, but it was passed into law as the Colonial Stock Act. Mr Mackrell was much interested in educational questions, and endowed, through the Law Society, a prize known as the "John Mackrell prize" for articled clerks who, on passing their final examination, "should have shown the greatest practical knowledge of and capacity to advise upon and transact matters of business falling within the province of a practising solicitor as distrinct from the mere knowledge of the principles and practice of the law."
