(PROB 11/1710:267) IN THE NAME OF GOD AMEN. This is the last Will and Testament of me Charles Smith of New Grove, Mile End, in the county of Middlesex, Agent. In the first place I direct that all my just debts funeral and testamentary expenses be fully paid and satisfied by my Executors hereinafter named as soon as may be after my decease I give and bequeath unto my dearly beloved wife Ann Smith all the household furniture linen wine liquors china glass pictures prints place and implements of household furniture which may belong to me and be in my possession at the time of my decease for and during the time she remains my Widow I hereby nominate and appoint my sons Charles Smith and Robert Smith Executors of this my Will and I give and bequeath unto my said Executors all my monies debts of every description and securities for money together with every state matters and things not herein disposed of to former Capital for continuing and carrying on my business and I direct that after my decease they my said Executors shall carry on and conduct my business in the same way and manner as the same it was carried on under the direction of my said son Charles Smith and it is my Will and desire that my son Charles Smith shall continue to employ in the same business my son Samuel Robert Smith and my said son Robert Smith as they are now engaged and employed until they shall otherwise agree among themselves but in whatever way or manner the said business may be arranged carried on and conducted. I direct that my said Executors shall and from time to time after my decease pay or cause to be paid out of the profits of my said business unto my said wife Ann Smith the annual sum of three hundred pounds by quarterly payments and her receipt alone shall be a sufficient discharge for the same. I direct my Executors to pay to my said wife immediately after my decease the sum of one hundred pounds for her immediate use and I hereby direct that my said wife shall from time to time as and when shall receive the said quarterly payments of the aforesaid bequest of three hundred pounds to pay unto my daughter Elizabeth Smith at and after the rate of thirty pounds per annum for her sole and separate use and to be applied and disposed of as she my said daughter the annual sum of one hundred pounds by quarterly payments to and for her own sole and separate use during so long only as she shall remain sole and unmarried and immediately after the decease of my said wife I direct that all my household furniture linen wine liquers china glass pictures prints plate and implements of household furniture hereinbefore given to my said wife during her widowhood shall be sold by my said Executors and the proceeds thereof equally divided by them among all my children who shall be then living share and share alike and I hereby give to my said Executors the sum of twenty pounds each for their trouble in the execution of the provisions of this my Will hereby revoking all other Will or Wills by me at any time heretofore made and declared this to be my last Will and Testament in Witness whereof I the said Charles Smith the Testator have hereunto set my hand and seal this thirteenth day of October one thousand eight hundred and twenty five. I CHARLES SMITH of Brunswick Place, Bowyer Lane, Camberwell, in the County of Surry, Ship Agent, do hereby revoke all wills codicils and other testamentary dispositions made by me at my time or times heretofore and do publish and declare this to be and contain my last Will and Testament I do hereby nominate constitute and appoint my dear wife Frances Smith Executrix and James Heuson of Weymouth Street, Newington in the county of Surry, Traveller and Thomas Coxhead of Berresford Street, Newington aforesaid Accountant Executors of this my Will In the first place I direct my Executrix and Executors or the survivors or a survivor of them to pay all my just debts funeral and testamentary charges and expenses as soon as conveniently may be after my decease My funeral as also the place of my interment I leave to the sole management and direction of my said wife if she shall be living at my decease but in the event of the death of my said wife in my lifetime I leave the direction of my funeral to be arranged by my children if either of them shall have attained the age of sixteen years but if not then as my executors or the survivor of them shall see fit whereas I have lately affected an insurance on my life for the sum of five hundred pounds in the Office called the Clerical Medical and General Life Assurance for the Assurance of lives and I am possessed of the policy granted in pursuance of such insurance numbered 137 and dated the seventh day of June last under the hands and seals of the then acting Directors of the said Company And I am also possessed of interested in and entitled to an interest in two ships or vessels the one called the Havante and the other called the Jubilee my share and interest in the Havante being one eighth part and my share and interest in the Jubilee being one quarter part and I am also wholly interested in certain craft boats and other things appended and appurtenant to such craft Now I do hereby give devise and bequeath unto my said wife Frances Smith and the said James Heuson and Thomas Coxhead and the survivors and survivor of them the said sum of five hundred pounds to be received from the Directors of the said Insurance Office called the Clerical Medical and General Life Assurance Office and all addition that may be made thereto in way of terms or otherwise And instruct my Executrix and Executors or the survivors or survivor of them to receive the same and immediately after the receipt thereof to lay out and invest the said sum of five hundred pounds together with such additions as aforesaid of any interest in their joint names or in the names or name of the survivors or survivor of them in some or one of the public funds of Great Britain and to stand possessed thereof for the purpose hereinafter mentioned I also give devise and bequeath unto my said Executrix and Executors and the survivors and survivor of them all my parts shares and interests in the said ships both and either of them whichever may be the case at the time of my death and all monies or securities that may be then one and owing to me in respect thereof and I desire them my said Executrix and Executors and the survivo rs or survivor of them to collect and receive with all possible dispatch after my decease all monies that may be coming due or owing to me in respect of my shares and interest in the said ship or either of them and to lay out and invest the monies so to be received by them or either of them in Government stocks funds or securities in them joint names or in the name or names of the survivors or survivor of them and to stand possessed thereof upon the trusts herein before mentioned And I leave it to the discretion of my said Wife whether she will continue my interest in the said ships or cause the same to be sold And in the cause of my said Wife determining not to continue my share and interest in such ships Then I direct my said Executrix and Executors or the survivors or survivor of them to cause the same to be sold by Public Auction unless it shall appear to them on the best information they can obtain that it will be most advantageous to dispose thereof by private contract And direct them my said Executrix and Executors and the survivors or survivor of them to concur in every Act that may be neccesary to facilitate the sale disposition or transfer thereof and the produce to arise by the sale disposition and transfer of my share and interest in such ships I direct my said Executrix and Executors to sell or cause to be sold as conveniently may be after my decease all my boats craft gear and implements of a lighterman or any way appertaining thereto and to invest the produce of such sale in their names in the names or name of the survivors or survivor of them in government securities for the purposes hereinafter mentioned I give devise and bequeath unto my said Executrix and Executors and the survivors and survivor of them my full and whole share and interest in whatever business or engagement I may be concerned in or interested at the time of my decease and all monies or securities for money in respect thereof book debts vouchers papers or instruments relative thereof and my stock of same wherever the same may be And I do direct them to dispose and convert of such part or parts thereof as may not consist of money into money and to lay out and invest the proceeds thereof with the money they may otherwise receive in life Government stocks or funds in their names or the names or name of the survivors or survivor of them for the purposed hereinafter mentioned And I also give devise and bequeath unto my said Executrix and Executors and the survivors or survivor of them all other my estate and effects of what nature quality or description the same may be except my household furniture and effects And I direct them to sell and dispose of such Estate and Effects (household furniture and effects excepted) and to lay out and invest the produce thereof in government stocks funds or securities in their names or in the names or name of their survivors or survivor of them And I do hereby declare that my said Executrix and Executors and the survivor or survivor of them shall stand possessed of and interested in the stocks funds and securities to be purchased as aforesaid and the dividends and interest to arise and become payable in respect thereof Upon trust to pay to or permit and suffer my said Wife to receive and take such interest dividends and proceeds during the term of her natural life if she shall so long continue my Widow to enable her to support herself and bring up and educate my children names Charles James Smith Marian Ellen Smith and Frances Smith and I commit the custody and guardianship of my said children to the care of my said dear Wife in full confidence of her affectionate zeal for their welfare and advancement And I give and devise and bequeath unto my said Executrix and Executors All my household goods and furniture plate china and linen and implements of household furniture And I direct that an Inventory shall be made thereof immediately after my decease And that two copies thereof shall be signed by my Executrix and Executors and the survivors and survivor of them one copy whereof shall be kept by my said Wife and the other by my Executors or the survivor of them And I desire that my said Wife shall have the exclusive use and enjoyment of all the articles and things mentioned and comprised in such Inventory during the term of her natural life if she shall so long continue my Widow And that immediately after her decease or marrying again the said household goods and furniture shall be sold and disposed of and the produce thereof laid out in government stocks funds or securities and invested in the name or names of my continuing executor or executors And that the whole of the stocks funds or securities so to be purchased by them as aforesaid shall be equally divided among my children when and as they shall attain the age of twenty one years And I declare that in the event of my said Wife marrying again she shall lose and forfeit all right and benefit under this my Will and cease to act as Executrix I direct that my children in the event of the decease of my said Wife or her marrying again shall not acquire or take any interest part share or proportion of the stocks funds or securities to be purchased as aforesaid until he she or they shall attain the age of twenty one years but in the event of either of such children dying under that age the share or proportion of the deceased child shall belong to and be shared by the survivors and if but one then to that only child unless it shall so happen that either of my child or children shall die before the death or marriage of my said Wife having been previously married and lease any child or children in which case it is my express will and intention And I hereby declare that if any or either of my children or child shall marry before the death or marriage of my said wife and leave any child or children lawfully begotten him her or them surviving then that the child or children so surviving his or her parent interested under this my will shall have and be entitled to the share and interest which his or her deceased parent would have survived if such parent had lived until the death or marriage of my said Wife And if all my said children shall die without leaving any child or children lawfully begotten him or them surviving Then I direct that the stocks funds and securities to be purchased with or out of my Estate and Effects shall be divided according to the Statute for the distribution of Intestates Estates and Effects And I hereby declare my will and intention to be that if I shall leave any one or more child or children I now have And I give and bequeath unto the said James Heuson and Thomas Coxhead the sum of ten guineas each as a token of my respect and esteem for them provided also and I do hereby further declare that it shall and may be lawful to and for my said Executrix and Executors and the survivors and survivor of them and their his or her respective have executors and administrators by and out of all or any of the monies which by virtue of this my will shall come to their or any of their hands deduct certain to and reimburse himself herself and themselves and also to pay to his her or their co executors all such costs charges and expenses as they respectively shall or may sustain expend or be put unto in or about the execution of this my Will or all or any of the trusts aforesaid And also that they the said Frances Smith, James Heuson and Thomas Coxhead their respective heirs executors and administrators shall be charged and chargeable only every of them for and with his and her own respective receipts payments acts and wilful defaults and not otherwise and shall not be charged or chargeable with or for acceptance or sums of money other than such as shall actually and respectively come to them on any or either of their hands by virtue of this my will nor with or for any loss or damage which may happen in or about the execution of all or any of the trusts aforesaid without his her or their wilful default In witness whereof I the said Charles Smith have to this my last Will and Testament APPEARED personally Peter Smith Manico of Peckham in the County of Surry Surgeon and made oath that he is one of the subscribed witnesses to the annexed Codicil as well as the drawer and writer thereof being the Codicil to the last Will and Testament of Charles Smith late of Brunswick Place Bowyer Lane Camberwell in the County of Surrey Ship Agent deceased the said Will bearing date the nineteenth of October one thousand eight hundred and twenty six and the said Codicil bearing date through error the month of October 21st 1833 instead of the month of March that this deponent was present when the said deceased executed the said Codicil on the said twenty first day of March one thousand eight hundred and thirty three and that the error in the said date entirely arose from this deponent inadvertently inserting the month on which the will bears date and which had been rented in the body of the said Codicil instead of the month of March the month in which the said Codicil was executed as aforesaid PS Manico On the 8th day of April 1833 the said Peter Smith Manico was duly sworn to the within Affidavit before use WC Curteis Sur PRest Wm Gostling .

PROVED at London with a Codicil 9th April 1833 before the Worshipful William Calverley Curtois Doctor of Laws and Surrogate by the Oaths of Frances Smith widow the Executrix named in the will and James Plummer the Executor named in the said Codicil to whom Admon was granted having been first sworn duly to administer.

TRANSCRIPTION:I Ann Smith of Number 5 Grove Road, Mile End Road in the County of Middlesex, Widow, do hereby revoke all former wills, codicils and other testamentary dispositions, and declare this to be my last Will and Testament

I particularly wish and desire to be buried by the side of my dear husband in the old family vault in Stepney Church Yard with plainness and privacy which desire of mine I believe will rejuvenate it as the vault is not a Faculty one.

I bequeath to my son, James Smith of Launceston, Tasmania, in the Colony of New South Wales, my mourning keeper ring, worn by me in memory of my husband,

- also my printed picture of the death of the late Captain Cook,

- and also my portrait of him,

- also my two portraits of the King of Otaheite,

- also my two landscape prints or pictures,

- also my Celestial Globe and set of Celestial Maps,

- and also my best damask table cloth figured with men and animals and other

- also my little Thermometer (?) standing on my Chimney Piece in the front parlor,

piece in my back parlor

- also the remaining half of my dozen silver teaspoons

- and also all my other teaspoons now in common use

- also my figured sugar tongs and tea caddy silver spoon and dessert spoon and silver

fork now in daily use by my daughter Ann Elizabeth

- and also my two silver …. spoons, now in daily use.

And whereas I am possessed of numberless little petty personal articles which I cannot well describe or enumerate (beyond what I have specifically mentioned) and which yet are of little intrinsic value, Now therefore I give and bequeath all such articles falling under this denomination to my dear daughters, the said Margaret Ann Place and Ann Elizabeth Smith, to be divided between them equally, share and share alike.

I bequeath to my son Charles Cooke Smith,

- a dozen or one other fourth of my knives and forks in my said two Mahogany cases

- also one other of my four best damask table cloths and the remaining ……… of my

table linen and napkins,

- also my Mahogany writing desk formerly in use by my late husband

- also all the various old clubs, netts and such like, pretty personal things lately

belonging to the said Captain Cooke

- also my book of prints, illustrations of his, the said Captain Cookes Voyages

- also the six chamber towels now in common use in my servants room

But I Will and declare that the foregoing bequests to my said son, Charles Cooke Smith, and his share in the residue of my personal estate hereinafter bequeathed, is only to take effect in the event of his delivering up to my Executrix and Executor hereinafter named, within one calendar month after my decease, the bed bolster and pillows I lent him some time ago, and in default of his so doing, the foregoing bequests to him, and his share of the residue, shall fall into and form part of my residual personal estate

I bequeath to my son Isaac Bressey Smith

- the remaining dozen, or one fourth part of my knives and forks, in my said two

Mahogany cases

- also my Cribbage box and its contents

- and my little Mahogany Chess board, and the ivory chess men belonging to it

- also my brown silk umbrella

- and also the ten chamber towels usually used by him

And whereas my said son Isaac is at present residing with me, and out of employment Now my desire is, if expedient, and I hereby empower my said Executrix and Executor, in case he, my said son, should at the time of my death be still out of employment and residing with me, to permit him to remain in my house if they in their discretion think proper, but under their absolute authority, until within one week of the sake of my furniture and effects, but no longer on condition of him conducting himself to their satisfaction during such period, and in no way interfering with my said Executrix and Executor, or with my estate and effects,

 

And as to all the rest, residue and remainder of my Personal Estate, furniture and effects whatsoever, and wheresoever.

I bequeath the same to my said daughter Margaret Anne Place and Robert Smith of Southgate Terrace, Southgate Road, Hoxton (my brother), their executors, administrators and assigns, upon trust, with all convenient speed after my decease, to sell, call in, and dispose of, and convert into money, all my said residuary personal estate, furniture and effects, and out of the monies to arise from such sale, calling in, and conversion, and the money due to me of which I shall be possessed at my death, do and shall in the first place pay and discharge all my just debts, funeral and testamentary expenses, and the costs of proving this my Will, and subject …….

……. …… residue thereof between and amongst all and every my dear children equally, share and share alike (subject however to the restriction hereinbefore mentioned as to my son, the said Charles Cooke Smith), and I empower my Executrix and Executor to give effectual ……. for all monies paid to them, and to reimburse themselves all costs and expenses which they may properly incur as my Executrix and Executor

And I nominate, constitute and appoint my daughter Margaret Anne Place, and my brother Robert Smith Executrix and Executor of this my Will. In Witness whereof, I the said Ann Smith have hereunto set my hand, and have also set my hand to each of the preceding sheets of this my Will, this twelfth day of July in the year of our Lord one thousand eight hundred and fifty nine Ann Smith

PROBATE ON THE NINTH DAY OF NOVEMBER one thousand eight hundred and twenty eight I Alexander Wright Smith of this City of London, Cotton Dealer, being of sound mind though weak in body do make this my last will and testament and declare that thereby constitute and appoint my brother John Smith sole Exec and Legatee to all property goods monies and effects whatsoever and wheresoever which I do now possess or may at my death possess or be entitled to and I also appoint the said John Smith to be sole Executor of this my will given under my hand and seal this 9th Day of November 1828. A W Smith Witness John Atkinson.

APPEARED PERSONALLY Thomas Ravens Atkinson of No 20 Stepney Causeway Commercial Road in the County of Middlesex Ship Broker and made oath that he knew and was well acquainted with Alexander Wright Smith late of Little New Street, Shoe Lane in the City of London, cotton dealer, deceased for several years before and to the time of his death and during such his knowledge of and acquaintance with the said deceased he frequently saw him with and also write and subscribe his name to writings and having more carefully viewed the signature A W Smith set and subscribe to the paper writing hereunto annexed purporting to be the last Will and Testament of the said deceased beginning “On this ninth day of November One thousand eight huyndred and twenty eight” and ending “know then under my hand and seal this 9th November 1828” he he saith that the said signature of A W Smith so set and subscribed to the said Will is of the proper handwriting and subscription of the said Alexander Wright Smith deceased. PROVED at London 12th December 1828 before the worshipful Thomas Blake Doctor of Laws

Surrogate by the oath of John Smith the brother sole executor to whom Admon was granted having

been first sworn only to administer.

 

Executor was brother John Smith.

The Gazette p.375 Pursuant to a decree of the High Court of Chancery made in a cause wherein Thomas Anderson and others are plaintiffs, and Charles Smith and others are defendants, the Creditors of Charles Smith, late of New Grove, Mile End, Middx, Agent (who died in or about Nov 1825) are to come in and prove their debts before Henry Martin, Esq, one of the Masters of the said Court, ………..on or before the 10th day of March 1832, or in default thereof they will be peremptorily excluded the benefit of the said Decree.
